This Privacy Policy explains what information Engineering Performance Innovations, LLC, doing business as Marine 316 (“Marine 316”, “we”, “us”, “our”), collects when you use marine316.com or buy from us, how we use it, who we share it with, and the choices you have — including the text messages we send only to customers who ask for them.

Marine 316 is an online retailer of marine supplies: window film and film application tools, marine films, personal watercraft accessories, content creation gear and related products. We collect only what we need in order to take, fulfill and support your order.

Information you give us directly

• Account and contact details — your name, email address, mobile or landline phone number, billing address and shipping address.

• Communications — the messages you send us through the contact form, by email, by phone or by text message, and our replies.

Information collected automatically

• Technical and usage data — IP address, browser and device type, pages viewed, referring page and the contents of your shopping cart, used to run the store, keep it secure and understand overall traffic.

Information we do not collect

We do not store full payment card numbers or bank account details on our systems. Card payments are processed by our payment provider on its own secure systems, and we receive only the confirmation and the last digits needed to identify the transaction. We do not buy contact lists or phone numbers from third parties, and we do not knowingly collect sensitive personal information.

How you opt in

We send text messages only to customers who have expressly agreed to receive them. You may give that consent in any of these ways:

• By checking the SMS consent box at checkout on marine316.com. The box is unchecked by default and is never checked for you.
• By checking the same SMS consent box on the contact form at marine316.com/contactus.
• By telling us in writing, by email or by signing a form that contains the same consent language.

In every case the consent language reads: “I agree to receive text messages from Marine 316 about my order. Message frequency varies. Message and data rates may apply. Reply STOP to unsubscribe or HELP for help.”

Consent to receive text messages is not a condition of purchase. You can buy from us without ever giving us a mobile number.

What we send

Under this program we send only service-related messages about your own order, such as:

Carriers and delivery

Mobile carriers are not liable for delayed or undelivered messages. Delivery depends on the availability of your carrier's network.

Section 5Marketing email

If you subscribe to our newsletter, we send you email about products, offers and news. Every message includes an unsubscribe link, and you can also unsubscribe by contacting us. Marketing email is entirely separate from the text message program described in Section 4: subscribing to one never subscribes you to the other, and unsubscribing from one never affects the other.

Section 6How we share information

We do not sell or rent your personal information to anyone. We share limited information only in these situations, and only to the extent needed:

• Service providers who work for us — our website and store platform host, our payment processor, our messaging platform and our email provider. They may use your information only to provide their service to us, under contract, and never for their own marketing.
• Shipping carriers and suppliers — the name, address and phone number needed to deliver your order or to ship it to you directly from a supplier.
• Professional advisors — our accountants and attorneys, when required to run the business.
• Legal requirements — when we are required by law, subpoena or court order, or to protect our rights, our customers, or the safety of others, including fraud prevention.
• Business transfer — if the business is sold or merged, information may transfer to the successor, which would remain bound by this policy.

As stated in Section 4, mobile phone numbers and SMS consent data are excluded from all of the sharing described above, other than delivery of the messages themselves.

Section 11Children's privacy
